8. Data Responsibility
You are solely responsible for all data, prompts, files, documents, content, and materials that you submit to the platform, and for ensuring that you have all rights, permissions, notices, and consents necessary to provide that data and permit its processing.
Aiandi is not responsible for reviewing your inputs for legality, accuracy, appropriateness, ownership, quality, or compliance.
9. File Uploads
If the platform permits file or document uploads, you acknowledge that uploaded content may be read, interpreted, summarised, transformed, classified, or analysed incorrectly. Formatting, images, tables, diagrams, metadata, handwritten notes, scanned text, or embedded content may be misread or omitted.
You remain solely responsible for reviewing and validating any output based on uploaded files before relying on or distributing that output.

11. Security Disclaimer
Aiandi takes reasonable steps to help secure the platform, but no internet-based service, software system, storage environment, or transmission method is completely secure or error-free. You acknowledge that use of the platform involves inherent security and availability risks, including unauthorised access, data loss, corruption, delay, interception, outage, or service interruption.
12. Third-Party Services
The platform may depend on, interoperate with, or incorporate third-party services, models, APIs, infrastructure, integrations, software, or websites. Aiandi does not control and is not responsible for the availability, accuracy, performance, security, legality, terms, privacy practices, or acts or omissions of any third party.
Your use of third-party services may be subject to separate terms and privacy policies between you and the relevant provider.
13. Availability & Changes
Aiandi may, at any time and without liability, add, remove, modify, suspend, limit, or discontinue any part of the platform, including features, workflows, integrations, access methods, pricing, functionality, or technical requirements.
Aiandi does not guarantee that the platform will be available at all times, operate without interruption, or remain compatible with your systems, software, or workflows.
14. Beta Features
Any beta, pilot, preview, experimental, early-access, or pre-release feature is provided strictly on an "as is" and "as available" basis. Such features may contain defects, may change materially, may be removed at any time, and may be unsupported.
You use beta features entirely at your own risk.
15. Intellectual Property
As between you and Aiandi, Aiandi and its licensors retain all rights, title, and interest in and to the platform, including all software, code, interfaces, workflows, features, designs, know-how, documentation, branding, methods, models, and related intellectual property rights.
Subject to these Terms, Aiandi grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the platform solely for your internal lawful use.
No rights are granted except as expressly set out in these Terms.
16. Feedback Licence
If you provide suggestions, ideas, enhancement requests, comments, feedback, or recommendations relating to the platform, Aiandi may use, reproduce, modify, commercialise, disclose, and otherwise exploit that feedback without restriction or obligation to you.
17. Output Ownership
You retain ownership of information you input into the platform. You may use outputs generated by the platform for lawful purposes. Aiandi retains all rights in the underlying software, systems, algorithms, models, methods, and intellectual property.
18. Fees & Payments
If you use a paid tier or feature, you agree to pay all fees as set out in the pricing information. Payments are generally non-refundable except where required by law. Aiandi may change pricing with notice, and such changes apply to future billing cycles only.
Annual & Long-Term Billing. Where you elect to pay upfront for an annual or other long-term billing period, the full amount is charged at the start of the billing period and is non-refundable. Discounted pricing is offered for longer-term commitments in consideration of the upfront, non-refundable nature of the payment. By selecting an annual or long-term plan, you acknowledge and agree that no pro-rata or partial refunds will be issued for unused portions of the billing period, including in the event of voluntary cancellation, downgrade, or account closure. Your access to the paid tier will continue until the end of the prepaid billing period. This clause does not affect any rights you may have under applicable consumer protection laws.
19. Suspension & Termination
Aiandi may suspend or terminate your access to the platform immediately, without liability, if these Terms are breached, misuse occurs, payment fails, or continued access creates legal or operational risk.
20. Warranties Disclaimer
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. AIANDI DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Aiandi does not warrant that the platform will be uninterrupted, error-free, secure, or free of defects.
21. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AIANDI EXCLUDES LIABILITY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, BUSINESS INTERRUPTION, REPUTATIONAL HARM, OR COST OF COVER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
22. Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIANDI'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE PLATFORM WILL NOT EXCEED THE GREATER OF: (A) FEES PAID BY YOU DURING THE PREVIOUS THREE MONTHS, OR (B) $100 AUD.
23. Indemnity
You agree to indemnify, defend, and hold harmless Aiandi and its officers, directors, employees, agents, and representatives from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from your use of the platform, reliance on platform outputs, data you upload, breach of these Terms, or any third-party claim relating to your use of the platform.
24. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any non-excludable consumer rights available under the Australian Consumer Law or other applicable legislation that cannot legally be excluded or limited.
25. Force Majeure
Aiandi is not liable for any failure or delay in performing obligations under these Terms caused by events beyond its reasonable control, including acts of God, pandemics, war, terrorism, natural disasters, or government action.
26. Assignment
Aiandi may assign these Terms or any rights or obligations under these Terms to any third party without notice. You may not assign these Terms or any rights or obligations without Aiandi's prior written consent.
27. Entire Agreement
These Terms constitute the entire agreement between you and Aiandi regarding use of the platform and supersede all prior negotiations, representations, and agreements, whether written or oral.
28. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if not possible, severed. The remaining provisions will continue in full force and effect.
29. Waiver
Aiandi's failure to enforce any right or provision will not constitute a waiver of that right or provision, nor will any partial exercise of a right or provision preclude further exercise or enforcement.
